Yogi government relieved of High Court in Love Jihad case, court refuses to stay interim

The Yogi government of UP has got relief from the Allahabad High Court on the Love Jihad Ordinance. The High Court has refused to impose an interim stay on this ordinance. The court has sought a detailed reply from the Yogi government till January 4. After this, the petitioners will have to file an affidavit on the 6th. The final hearing in the case will be held on 7 January. The case was heard in a division bench headed by the Chief Justice.

Four separate applications were filed against the Love Jihad Ordinance. In these applications, the government has been accused of taking political advantage. The petitioners had also demanded that the accused should not be arrested in all the cases registered under the Love Jihad Act so far. However, the court also rejected this demand of the petitioners.

At the same time, the government also presented its stand during the hearing. The government said that ordinance has become necessary to maintain law and order in the state. On behalf of the government, it has been said that the law and order was deteriorating after the increasing cases of conversion in UP. That is why this ordinance was brought.

Significantly, a law has been made against Love Jihad in Uttar Pradesh. The state government had on November 24 approved this ordinance to deal with cases of forcible or false conversion for the sake of marriage, under which the guilty person can be imprisoned for up to 10 years. The ordinance was approved by the state governor Anandiben Patel on 28 November.
