The Delhi High Court Monday granted permission to a lady for medical termination of her 25-week being pregnant because the survival of the foetus, affected by severe abnormalities, is unlikely. The excessive courtroom allowed the petition by the 25-year-old pregnant girl who was in search of permission to abort the foetus on the bottom that it was affected by Bilateral Agenesis and Anlyaramni, contemplating the report of AIIMS that the situation is poor and “survival of foetus is unlikely”.
“I see no reason to deny permission for medical termination of pregnancy. The petition is therefore allowed,” Justice Navin Chawla mentioned.
The courtroom’s permission was required as Section 3 of the Medical Termination of Pregnancy Act doesn’t allow termination of being pregnant in case the interval of gestation is greater than 20 weeks.
The excessive courtroom had earlier directed the Medical Superintendent (MS) of AIIMS to forthwith represent a board to look at the situation of the girl whose foetus was affected by severe abnormalities.
It had requested the MS of All India Institute of Medical Sciences (AIIMS) to submit the report relating to the medical situation of the foetus and the potential for the foetus not surviving the time period of the being pregnant.

Advocate Sneha Mukherjee, representing the girl, submitted that the foetus wouldn’t survive until childbirth as each the kidneys haven’t developed as but and added that within the circumstances it might be futile to compel the petitioner to endure the complete phrases of being pregnant.
The plea mentioned throughout an ultra-sonography, carried out on the girl on the gestational age of 25 weeks, it was found that the fetus suffered from Bilateral Renal Agenesis (each kidneys absent) thereby making it incompatible with life.
However, the girl had crossed the 20 weeks mark and medical termination of being pregnant is restricted thereafter.
